Interim Terms of use for using Fribiz.com

Welcome to Fribiz.com ("Fribiz" or "the Website"). This document constitutes a binding contract agreement between Fribiz LLC. (Hereinafter:  "Fribiz", "We", or "Us") its casual visitors (Hereinafter: "Visitors") and visitors who are registered to Fribiz (Hereinafter: "Users" or "Registered Users" or "Members").

Please read the following terms, follow our statements, know your rights and obey your obligations. By accessing the website, you hereby accept the following terms. If you don't agree with any of the following, do not use and/or visit the website.

Age minimum

Fribiz does not allow the participation of children under the age of 13. Since fribiz allows its registered users to purchase fribiz points by credit cards, Pay-Pal or other payment methods – you must be at the minimum legal age specified in your country's laws which allows making such payments. If you are not sure what is the minimum legal age to make such payments, do not use fribiz until you do.

 Registering as a User

Users who registered as members of fribiz are entitled to operate functions such as: place bids on products, buy fribiz, invite friends, read messages, get notifications, get compensated and any other action which is not enabled for casual visitors and any other kind of non-registered visitors.

E-mail as an agreed communications method

We will send you alerts, messages, notifications and generally communicate with you through our internal messaging system which is connected to the e-mail account you were asked to provide as part of the registration process. You hereby consent that electronic communication is acceptable as means of communications.

True Identity and Information

Every person may have one Fribiz account only. All information given by you must be true and authentic. This includes: real full name, e-mail, location, birth date, and any other information. Trying to create false accounts and/or giving false, fake or unauthorized information will give us the right to terminate or take action against such accounts and all other accounts which seem to be originated by the same person or persons.

Earning and using Fribiz points

Your Fribiz points (Hereinafter: "Diamonds" or "Points") are gained by various activities. That includes: buying points, inviting friends and referring users to fribiz, entering Fribiz Gift Card key password, cooperating with any of our associated websites (websites which implemented the fribiz API) and any other special event that we choose to establish.

Fribiz points are not a currency and are non-refundable, non-transferable, and not redeemable. Fribiz points can only be used on fribiz.com for placing bids on one or more of our auctions. The sole purpose of the Fribiz Points is to grant you the possibility to place bids on auctions published at fribiz, and for this purpose only.

We may, in our sole discretion, change, add or cancel any of the methods of earning points and using them.

Termination & actions against abusers

Any suspicious activity that indicates abuse of our system or other rights in order to illegally affect our website or affect the normal process of points distribution- may result in taking actions against such abusers. In order to prevent or stop abuse we may: ban users, delete accounts, decrease points, increase points, cancel shipments of products, take legal actions against abusers and submit any information we may have regarding such abusers to the relevant authorities and courts.

Here are a few examples for actions we might find abusive: * Publishing misleading links which actually refer to fribiz accounts. * Sending unsolicited messages (by e-mail, Social networks or any other messaging system) to an disproportionate group of people in a manner that may disturb them in an unlawful way. *Using unauthorized or stolen credit card details. * Using more than one profile for the same computer / IP address / shipment details. * Trying to sell or buy fribiz accounts from or to others (This includes paying others to register or engage in way with fribiz) * Owning more than one account per individual.

Shipment limitation

Registering to Fribiz is open for users from all around the world and there are no jurisdictional limitations for participating in fribiz. However, it is possible that some of our products cannot be shipped to certain countries due to legal prohibitions and/or logistic reasons. If such incidents occurs, we will try to (but we are not obligated to) find an equivalent solution.

Please note that we may also offer certain products which are relevant only to certain countries, cities or areas. Such auctions will include information regarding the relevant delivery details or a link to the supplier's shipment details.

If you win a product, it will be packaged and shipped to your address for FREE within 30 days after the auction ends and you receive a notification you have won. Please note you that we cannot, and will not be held responsible on any incidental expenses, restrictions or prohibitions you might encounter at your local jurisdiction. All customs duties / taxes / commissions / local prohibition (if there are any) are to paid and / or to be taken care solely by you.

Disclaimer of Warranty

We disclaim any warranty to any of the products presented and offered in fribiz. Any warranty given by the manufacturer of a product or anyone else will be supported by the party who gave such warranty and not by us. To the full extent permissible by law, we do not make any warranty to the availability of the website, it's safety, its accuracy nor to its correct operation.

Limitation of liability

The use of the website is at your own risk and responsibility. Fribiz, including all of its information, products, auctions, platform and services are provided "as is" and "as available" basis. We are and will not be liable to any kind of damages that you or any third party might suffer or claim due to your or other's use of fribiz or in connection with fribiz or any of our associates.

Intellectual property

All of our content, including all visual graphics, logos, text, videos, sound clips, information and computer codes are our intellectual property. Our rights include, but not limited to copyright, patents, trademarks and other intellectual property rights we own or are entitled to, or are using with permission.

You are granted to access fribiz for your personal use and normal surfing activities only and not to copy, make derivative works or any other use out of our content which is not for the sole purpose of normal browsing the website.

"BETA" NOTIFICATION

The website is currently at its first stages of public launch ("Beta Version"). It is possible that some elements in our software will not operate perfectly. Therefore, it is expected that during your use, some errors, faults, crashes downtime period might occur. We are making constant efforts to prevent and fix such incidents and malfunctions, but we cannot and will not be held responsible for any kind of damages, expectations or other accusations regarding any use of the website or its behavior.
